This Privacy Notice explains what information The Movement Dance Foundation Inc. (“The Movement” “we”, “our”, or “us”) collects about you when you visit this website www.themvmt.org (the “Website”), how we use this information, with whom we share it, and the choices you have in connection with this.
1. INFORMATION WE COLLECT AND WHY
Through your use of our Website, we collect personal information, which is information that identifies you as an individual, relates to you as an identifiable individual or, that along with other information, could identify you (collectively, “Personal Information”). We collect the following types of Personal Information:
A. Information You Provide To Us.
When you engage with certain aspects of our Website we collect Personal Information from you. This includes when you:
Sign up to be a member. If you sign up to be a member on our Website, you will need to provide your first and last name, email address, password, age of the person who will participate in the class by selecting one of the following from a drop down menu (13-17, 18-25, 26-30, 31-40, 41 and over), how you heard about The Movement by selecting one of the following from a drop down menu (Facebook, Instagram, TikTok, Email, Dance Instructor, Dance Student, A Friend), what has stopped you from taking a dance class before by selecting one of the following from a drop down menu (I don’t have enough time, I didn’t know where to find them, Classes are too expensive, There’s not enough intro-level classes, I never thought about going to a dance class before), what made you want to try a class with The Movement by selecting one of the following from a drop down menu (Classes are free!, Class times work with my work/school schedule, Classes are intro-level, The class caught my attention, The instructor), and whether this is your first time attending any class (through The Movement or not) by selecting one of the following from a drop down menu (yes, no).
In addition to the above, in order to sign up to be a member you will have to check a box that you have read and agree to the Terms of Use, check a box that you have read and agree to the Privacy Policy, and check a box that you are the attendee and you are at least 18 years old and have read and agree to the Liability Waiver and Release (Including COVID-19) for Adults or you are the parent or legal guardian of the minor attendee and have read and agree to the Liability Waiver and Release (including COVID-19) for Minors.
As a member, you will have an account which will allow you to (1) create and/or edit a display name that is visible to all members of the Website; (2) update and edit your information you share publicly if you wish to provide it, your first name, last name, email address (except your login email address), and your phone number; (3) hide or make private your profile page and social aspects of your account; (4) make your profile public so that your display name, profile pic, comments and likes will be visible to other members; (5) block members, view members that are blocked, and unblock members; (6) track and manage your upcoming and past events and/or classes and/or sessions including viewing the event details (title of event, time, date, and location), viewing the order number, ticket type, price, quantity, and total, downloading tickets, and sharing the event; (7) save your credit and debit card details for faster checkout; (8) share something about yourself by writing in an open text box (the contents of which could be Personal Information) or add an image, video, divider, GIF, or emoji; (9) share your profile on Facebook, LinkedIn, Twitter, or copy a link to your profile; (10) follow or unfollow other members and/or allow other members to follow you; (11) include a photo in your profile and change the photo; and (12) include your profile as an attendee of an event and permit others to see what classes or sessions you have signed up for.
Login to the Website. In order to login to the Website, you will need to provide your email address and password as a member of The Movement. Alternatively, you may login by using your Facebook account credentials by including your name or phone number plus password, or login by using your Google account credentials. Google will share your name, email address, language preference, and profile picture with The Movement.
Register, RSVP, or Book a Free Class. If you, or you on behalf of your child, wish to register, RSVP, or book a free class on our Website, you first need to sign up to be a member. Once you have signed up to be a member, to register, RSVP, or book a free class you will need to login to the Website. After you have logged in, you will need to provide your first and last name, email address and, if you wish, your phone number to register, RSVP, or book a free class.
Interact with our Social Media. If you interact with us on our Instagram, LinkedIn, Twitter, TikTok, or Facebook account we may collect your name, email address, photo, list of social media contacts, and any other information you make, or which is, accessible to us when you connect with us. We collect this information to allow you to follow us and interact with us. You may also use social media to communicate with us or interact with us, which could include Personal Information.
Make a donation. If you make a one time donation to The Movement by clicking on the button for $25, $100, $250, $1000 or a custom amount on the donate page of the Website and clicking on the button labelled “Next”, you will be taken to a checkout powered by third party Bolt and asked to provide your email address, phone number, first and last name, street address, suite/apartment number, city, state, postal code, and country. After clicking the button labelled “Continue”, you will be asked to provide a card number with the month and year of its expiration date, and a billing address and first name and last name if it is not the same as the contact. You will also have the option to check a box to save your information with Bolt for a faster checkout. You can then make your one time donation by clicking on the button “Pay”. If you checked the box to save your information with Bolt, by clicking “Pay” you agree to create a Bolt Account under Bolt’s Terms of Use which can be reviewed here and Bolt’s Privacy Policy which can be reviewed here.
If you wish to make a monthly recurring donation, you may subscribe through PayPal by clicking on the “Donate” button. You will then need to enter the donation amount and click the button “PayPal”, whereupon you will be taken to the website of PayPal where you can make a donation by logging in to your PayPal account or as a guest with a debit or credit card. You can review PayPal’s privacy policy here. If you donate with a debit or credit card via PayPal’s website, you will need to provide your country/region by selecting same from a drop down menu, your card number, expiration date, security code, first and last name, the billing address associated with the card, and provide your contact information including type of phone number from a drop down menu, your phone number, and your email address. You can then checkout as a guest or save your information and create a PayPal account by clicking on a button “Create Account & Continue”. As per the wording on PayPal’s website as of the date of this Privacy Policy “By creating an account, you confirm you’ve read and agree to the E-Sign Disclosure and Consent to receive all communications electronically. You’ve also read and agree to the User Agreement and Privacy Statement. You will stay logged in for faster checkout.” PayPal’s E-Sign Disclosure and Consent agreement can be viewed here. When a donation is made through PayPal, The Movement can see the user's name, email address registered to PayPal, donation amount including currency, confirmation number, quantity of donations, and the time the donation was made. When a donation is made through Bolt, The Movement can see the user’s name, email address, phone number, the last four digits of the card used, donation amount including currency, and the time the donation was made.
Register for an 18 years or older only session, like Movement Mondays. If you are 18 years or older and register for a session that is only available to individuals 18 years or older on our Website, like Movement Mondays, you do not need to create an account but you will need to provide the buyer of the ticket’s first and last name, and email address, and to the extent it is different, the attendee’s first and last name, and email address, confirm that the attendee is 18 years of age or older by checking a box entitled “Yes”, confirm that you have read and agree to the Terms of Use, the Privacy Policy, and the Liability Waiver and Release (Including COVID-19) Adult, by checking the boxes entitled “Yes”, the option of providing text in an open text box after the question “Anything we should know?” (the contents of which could be Personal Information), and you must provide payment information including a card number, expiration date, security code (CVV), the card holder name, and billing address, including street, city, country, state, and zip or postal code.
Subscribe to our Website. If you sign up to our Website, you will be subscribed to our marketing emails. In addition, we send all attendees an email after class asking for feedback, the response to which could be Personal Information, and a small donation with a link to make a donation on our Website.
Sign up to know about MVMT class drops. If you sign up to be the first to know about new MVMT class drops, you will need to provide your email address.
Interact and view member profiles. If a member signs up for a class or a session using their account, any visitor of the Website can see any public aspects of the user’s profile which may include a name, photo, and the classes or sessions that member has signed up for. Conversely if you set up a member profile (see above “Sign up to be a member” paragraph), anyone visiting the Website can view the public features of your account which may include your name, photo, and the classes or sessions you have signed up for. You can report a member to us if their profile contains offensive content, offensive media, or spam and others can report you for the same reasons. You can also block or unblock a member.
Contact us by phone, email, or through our Website. When you contact us or send us any feedback, comments, or suggestions, we collect from you any Personal Information you choose to include in such communication, as well as your phone number if you contact us by phone and your email address if you contact us by email or send us a message from our “Contact Us” page on our Website. We use this information to respond to your questions, feedback, comments, suggestions, or inquiries.
B. Information Collected Automatically
When you use our Website, we use cookies and other technologies to automatically collect certain information about you. Cookies are text files that your web browser places on your computer or mobile device when you visit a website. Cookies can be “persistent” or “session” cookies. We use the Personal Information we collect about you to:

Allow you to sign up as a member.
Permit you to login to the Website.
Respond to your questions, feedback, comments, suggestions, or inquiries.

Permit you to register, book, or RSVP for a free class or to register, book, or RSVP your child for a free class.
Permit you to register for an 18 years or older only session, like Movement Mondays.
Allow you to create or edit your account and/or profile.
Communicate with you about our Website or to inform you of any changes to our Website.
Send you information on new classes and/or services we feel may be of interest to you.
Permit you to sign up to receive information from us when a new class is available.

3. HOW WE SHARE YOUR INFORMATION
We share your Personal Information for the purposes set forth below.
Service Providers. We share Personal Information with our service providers. We limit the information shared with our service providers to what is necessary to fulfill the services. We use the following providers:
Web development. To facilitate the development of our Website, we use Wix.com Ltd. You can view Wix’s privacy policy here.
Payment Processors. To make a one time donation to The Movement, we use a service provider called Bolt. You can review Bolt’s privacy policy here. To make a recurring donation to The Movement, we use a service provider called PayPal. You can review PayPal’s privacy policy here.
Analytics Providers. We use Google Analytics to collect information on your use of the Website to improve our Website. You may view Google Terms of Service here and the Google Privacy Policy here and for information about how Google uses the information provided to Google Analytics and how you can control the information provided to Google you can view here. To prevent your data from being used by Google Analytics, you can download the Google Analytics opt-out browser add-on for Google Analytics which can be found here.
Dance Instructors. If you choose to register, RSVP, or book a class or a session, we provide your first and last name to the dance instructor(s) for the class(es) or session(s) that you register for.
Corporate Reorganization. In the event that we enter into, or intend to enter into, a transaction that alters the structure of our business, such as a reorganization, merger, acquisition, sale, joint venture, assignment, consolidation, transfer, change of control, or other disposition of all or any portion of our business, assets or stock, we would share personal information with third parties, including the buyer or target (and their agents and advisors) for the purpose of facilitating and completing the transaction. We would also share Personal Information with third parties if we undergo bankruptcy or liquidation, in the course of such proceedings.
To Prevent Harm. We will share Personal Information if we believe it is necessary to detect, investigate, prevent, or take action against illegal activities, fraud, or situations involving potential threats to the rights, property, or personal safety of any person.
Legal Purposes. We will share Personal Information where we are legally required to do so, such as in response to court orders, law enforcement or legal process, including for national security purposes; to establish, protect, or exercise our legal rights, as required to enforce our terms of service or other contracts; to defend against legal claims or demands; or to comply with the requirements of any applicable law.
With Your Consent. We may request your permission to share your Personal Information for a specific purpose. We will notify you and request consent before you provide the Personal Information or before the Personal Information you have already provided is shared for such purpose.
4. CHOICES ABOUT YOUR INFORMATION
Update Profile and Account Information. If you set up an account with The Movement, you will be able to (1) edit your display name that is visible to all members of the Website; (2) edit your account information including your first name, last name, email address (except your login email address), and, if you wish to provide it, your phone number; (3) edit the information you share with The Movement community including editing your community page URL, hide or make private your profile page and social aspects of your account, and block members; (4) follow or unfollow other members and/or allow other members to follow you; (5) edit the photo in your profile.
Online Advertising. To opt-out of interest based advertising generally or to learn more about the use of this information you can visit the Network Advertising Initiative or the Digital Advertising Alliance. You can also visit the privacy settings of your Android or iOS device and select “limit ad tracking” (Apple iOS) or “opt-out of interest-based ads” (Android).
Google Analytics. You can control the information provided to Google by using one of the methods set forth here. You can also download the Google Analytics opt-out browser add-on for Google Analytics which can be found here.
Promotional Emails. You may opt-out of receiving marketing emails from us by clicking the unsubscribe link entitled “click here” provided with each email. Please note that we will continue to send you notifications necessary to the Website.
Cookies. All session cookies expire after you close your browser. Persistent cookies can be removed by following your browser’s directions. We implement and maintain commercially reasonable security measures to protect the Personal Information we collect. Our security measures include but are not limited to TLS 1.2. However, no security measure or modality of data transmission over the Internet is 100% secure and we are unable to guarantee the absolute security of the Personal Information we have collected from you transferred over the Internet.
7. THIRD PARTY LINKS
Our Website may contain links to other sites that are not operated by us. This Privacy Notice applies solely to the Personal Information collected on our Website. If you click on a third-party link, you will be directed to that third-party’s website. We strongly advise you to review the privacy notice of every website you visit.
8. CHANGES TO THIS PRIVACY NOTICE
The Movement reserves the right to amend this Privacy Notice at our discretion and at any time. Changes to the Privacy Notice will be posted on this page and will indicate the date the changes go into effect. Please check back and review the Privacy Notice for any changes. If we make any changes that materially affect your privacy rights, we will announce those changes by posting the revised Privacy Notice on our Website and will always indicate the date the last changes were published. If changes are significant, we will provide notice in an additional means we deem appropriate which may include directly notifying you by email.
